shaping the future: kansas legislature & homeschooling

About our Kansas Government

The Kansas legislature is composed of 125 representatives elected for two-year terms, and 40 senators elected to four-year terms.

The legislature conducts business under a biennium, or two-year term of legislative activity. Each session convenes the second Monday in January with final adjournment usually in April.

SB 114 – amends previous legislation that allows homeschoolers to participate in public school activities; became law in 2025 session.

What is the bill? https://kslegislature.gov/li/b2025_26/measures/documents/sb114_enrolled.pdf

How does the bill affect homeschoolers?

This bill was put forth in response to testimony from homeschool families whose students participated in public school sports but were banned from participation in “ancillary activities” such as awards banquets etc. The bill make such discrimination unlawful.

SB 75 – Passed out of Senate Education Committee; was not brought for vote in full Senate; VERY LIKELY to be brought for a vote in 2026 session.

What is the bill?

A refundable tax credit for students in accredited and non-accredited private schools. A refundable tax credit means that if the credit is more than a taxpayer owes, the taxpayer will receive the extra money. This money is government funding, or universal school choice.

How could the bill affect homeschoolers?

Government funding does not lead to more educational freedom. Examples in the U.S. and other countries clearly demonstrate that government funding leads to more regulation and higher prices for everyone whether you opt in for the funding or not. All homeschoolers would be negatively affected by increased regulations and increased educational costs.

Opposing testimony was submitted to the Education committee and homeschool families were alerted to communicate with legislators about the dangers of government funding eroding homeschool rights.

State Homeschool Organizations: Why Do They Matter?
If you’re a homeschooler in the United States, you’ve probably heard of state and regional homeschool organizations (like MPE!).

They tend to hold annual conferences (or conventions) and reminisce about “the old days” when parents could be thrown into jail just for homeschooling (no joke!).

But are they relevant for today?

A brief history of homeschool rights

Our homeschool rights are treasures requiring constant vigilance and responsibility.

Those newer to homeschooling may not realize that only a few years ago, brave families were facing court battles (and even threats of prison time) just for the “crime” of educating their children at home.

“Dr. Williams, I thought he was gonna say, 'Oh, honey, well, I can see you’re a concerned, involved parent. Let's see what I can do to help you.'

Instead, he said, 'Zan, if you continue down this path of homeschooling, I will have you put in jail for truancy.'

And I'll never forget the shock and fear that I felt at that moment in time.”
